Terms of Service

These Terms of Service ("Terms") govern your use of Enterwise ("we", "us", or "our") and our organizational mapping platform (the "Services").

By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

1. Eligibility and Your Account

• You must be authorized to use the Services on behalf of your organization
• You must provide accurate information when creating an account
• You're responsible for keeping your login credentials secure
• Notify us immediately at privacy@enterwise.app if you suspect unauthorized access

2. Pilot Status

• The Services are in beta testing and provided "as is"
• Features, performance, and availability may change without notice
• We may grant or revoke access at our discretion
• Feedback you provide may be used to improve the Services

3. Acceptable Use

You agree to:

• Use the Services only for internal business purposes
• Comply with all applicable laws
• Keep your account secure

You must not:

• Use the Services for illegal or harmful purposes
• Attempt unauthorized access to systems or data
• Interfere with the Services' operation
• Share access outside your organization without permission

We may suspend or terminate access if you violate these Terms.

4. Your Data

"Your Data" means organizational information you add to the Services:

• Department names, system names, process descriptions
• Organizational relationships and connections
• User names, roles, and affiliations
• Maps, diagrams, and visualizations you create

You own your data. You're responsible for:

• Accuracy and completeness of information you provide
• Having necessary rights to use this data
• Configuring access controls within your organization

5. License to Provide Services

You grant us permission to host, process, and display your data solely to:

• Provide and maintain the Services
• Prevent or address technical or security issues
• As required by law

We use third-party service providers (hosting, analytics) who act only on our behalf under contract.

6. Data Accuracy

The organizational maps you see are based on data you provide.

You should:

• Review maps for accuracy before relying on them
• Update information when your organization changes
• Validate important information before making decisions

We do not guarantee that maps will be complete or accurate if your input data is incomplete or inaccurate.

7. Our Intellectual Property

The Services (software, design, features) are owned by Enterwise.

These Terms don't give you ownership rights in the Services—only permission to use them according to these Terms.

8. Third-Party Services

We use third-party services (cloud hosting, authentication providers).

Your use of these may be subject to their own terms and policies.

We're not responsible for third-party services we don't control.

9. Fees

During pilot testing, the Services are provided without charge.

If we introduce fees in the future, we'll notify you with reasonable advance notice.

10. Termination

You can stop using the Services anytime.

We may suspend or terminate access if:

• You violate these Terms
• You use the Services in a way that causes risk or harm
• We discontinue the Services

Upon termination:

• Your access to the Services ends
• You can request an export of your data
• We'll handle data according to our Privacy Policy

Contact privacy@enterwise.app for data export or deletion requests.

11. Confidentiality

Your organizational data is confidential.

We will:

• Use your data only to provide the Services
• Protect it with reasonable security measures
• Not disclose it except as required by law or with your permission

12. No Warranties

The Services are provided "as is" without warranties, especially during beta.

We don't guarantee that:

• The Services will be error-free or always available
• Maps will be accurate or complete
• The Services will meet your specific needs

You use the Services at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law:

We're not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages beyond €100 or amounts you paid us (whichever is greater)

Some jurisdictions don't allow these limitations. In those cases, limitations apply to the fullest extent permitted.

14. Indemnification

You agree to protect us from claims arising from:

• Your use of the Services
• Your breach of these Terms
• Your data or how you share organizational maps

15. Governing Law

These Terms are governed by the laws of The Netherlands.

Disputes will be resolved in the courts of The Netherlands, unless local law requires otherwise.

16. Changes to Terms

We may update these Terms.

When we make significant changes:

• We'll update the date at the top
• We'll notify you through the Services or by email

Continued use after changes means you accept the updated Terms.

17. Miscellaneous

• If any part of these Terms is unenforceable, the rest remains in effect
• You can't transfer these Terms without our consent
• These Terms are the complete agreement between us
